Terms and Conditions
The work is undertaken upon the following Terms and Conditions:
A Notary’s first duty is to the transaction as a whole. Notarial acts are relied upon by clients, third parties, foreign governments and officials worldwide. Unless otherwise agreed in writing, a Notary’s responsibility is limited to the Notarial formalities and does not extend to advice on or drafting of documentation or in relation to substantive legal input on the matter under consideration. I do not give foreign law advice.
My charges are normally payable on presentation (usually at the meeting) by cash or cheque. Notarised documents will not normally be released until all fees and any amounts I have paid out on your behalf have been paid in full
- Documentation to be prepared.
I may need more than one appointment to finalise the matter, particularly if it is necessary for me to prepare all or some of the documentation.
- Written Translation.
In cases where I do not have knowledge of the language in which the document is written, official translations may be required before and/or after signing/execution of the documentation.
I carry professional indemnity liability cover of £1,000,000.00 which is the minimum level of cover specified by my Regulator (The Master of the Faculties). I therefore limit the level of my liability to you to £1,000,000.00 unless you are injured or die as a result of my negligence, in which case my liability is without limit.
- Signing of a document by more than one individual.
If two or more individuals need to sign/execute a document in my presence, where one or more has had to travel a considerable distance incurring expense in connection with travelling such a distance, if it transpires for whatever reason, the document is not in correct and acceptable form, I will not be liable for the costs associated with any individual travelling to attend on a subsequent occasion.
- Consequential loss.
I will not be liable for any loss of a consequential nature that may arise, if it transpires for whatever reason, the document is not in correct and acceptable form.
- Data Protection.
I use the information you provide primarily for the provision of my services to you and for related purposes including: updating and enhancing Client records, analysis to help me manage my practice, statutory returns, legal and regulatory compliance. If it is necessary to provide details in relation to you to a third party to achieve the aims in respect of what I have been instructed by you to do, you consent to such.
- Equality and Diversity.
I am committed to promoting equality and diversity in all of my dealings with Clients and third parties.
- The Relevant Law.
The Law that governs my contract with you is English Law and it is agreed that any dispute relating to my services shall be resolved by the English Courts.
All Notaries are required by their Regulator to hand to the Client a Prescribed Form of Words providing details of how and where a complaint can be made. A copy will be handed to you at the commencement of the appointment, but a copy can be Emailed to you earlier if requested.
